RESOLUTION #2024-71

Approving the sale or transfer of Lot 1 of BR3 Subdivision under the

 terms of a Development Agreement with BR3 Development LLC

WHEREAS,    The City of Monticello entered into a Development Agreement and BR3 Development LLC on the 4^th of March, 2021, by Resolution 2021-28, and

WHEREAS,    a term of the Agreement requires Council approval in writing of any sale or transfer of the Property, and

WHEREAS,    BR3 Development LLC has complied, or in is compliance, with all terms of the Development Agreement;

NOW THEREFORE, BE IT RESOLVED by the City Council of Monticello, Iowa does hereby authorize the transfer or sale of the subject property, and this Resolution shall be considered approval by the Council in writing.

IN THE TESTIMONY WHEREOF, I have hereunto subscribed my name and caused the Great Seal for the City of Monticello, Iowa to be affixed.  Done this  22^nd day of April, 2024.
