IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
RESOLUTION # 2022-7
Resolution to provide direction with regard to sale/transfer of City Owned Property located at 449 North Sycamore Street
WHEREAS, The City Council previously agreed to accept RFPs on City owned property located at 449 North Sycamore Street and thereafter received RFPs/proposals related to the property and scheduled a Public Hearing on the proposed sale/transfer of the property for tonight’s meeting, and
WHEREAS, The Mayor opened the Public Hearing, accepted Public Comment, and closed the Public Hearing before Council consideration of this Resolution, and
WHEREAS, The Council found the property located at 449 North Sycamore Street, which had been in disrepair for several years prior to the City acquiring the property, to be a blight on the neighborhood and the Council wanted to ensure the cleanup of the lot would proceed as quickly as possible and to return the property to the tax rolls, and
WHEREAS, The Council finds that the proposal received from Mike and Emily Kraus is the best option for this property as it includes construction of a new single-family home that will benefit the neighborhood and the City’s tax base, and
WHEREAS, The offer for 449 North Sycamore Street parcel, from Mike and Emily Kraus, includes a purchase price of $20,000, with $10,000 down payment and $10,000 due upon closing, contingent on the following conditions:
- In order to ensure Kraus proceeds with the construction in a timely manner, the City would hold title to the lot until Kraus has the weathertight building shell completed, at which point closing would occur;
- Kraus would provide a Certificate of Insurance, naming the City as additional insured, in order to proceed with construction on the City property, to assure his improvements are covered in case of fire or other calamity, and to protect the City from liability;
- The City and Kraus would meet with the neighbors and agree on the lot corners prior to construction – if no agreement could be reached, the City would provide a surveyor to stake the corners of the property;
- All other typical language in a purchase contract, and
WHEREAS, The Council finds that the City Administrator and City Attorney should work with Mike and Emily Kraus to finalize details and to have a purchase agreement prepared between the City and Mike and Emily Kraus, setting out the terms outlined above, with the costs of survey, if needed and closing costs to be covered by the City, prior to transfer and closing on the property.
NOW THEREFORE BE IT RESOLVED by the City of Monticello, through its’ City Council, in session this 17th day of January 2021 that the sale/transfer of the City property considered during tonight’s Public Hearing is hereby approved and the City Administrator is directed to work with Mike and Emily Kraus and to proceed with the preparation of a purchase agreement consistent with this resolution, and authorized to sign any documents to execute said agreement, and the eventual property transfer and closing.
