IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
RESOLUTION #19-134
Resolution to approve sale of City Owned Property off of Diamond Drive near Jaycee / Kleinow fields
WHEREAS, The City Council previously agreed to accept bids on City owned property near Jaycee Kleinow fields and thereafter received two bids/proposals related to the property and based thereon scheduled a Public Hearing on the proposed sale of the property for tonight’s meeting, and
WHEREAS, The Mayor opened the Public Hearing, accepted Public Comment, and closed the Public Hearing before Council consideration of this Resolution, and
WHEREAS, The Council finds that the land, while adjacent to City ball diamonds, is not used as part of that complex and has not over the years been utilized by residents for Park purposes, and
WHEREAS, The Council further finds that the funds generated from the sale of the lot could be used to further park and recreation projects that would be of benefit to the residents of the community, and
WHEREAS, The Council finds that it would be beneficial to maintain a comfortable green space around the park, based partially upon comments received by some of them from the public, and therefore finds that the sale of a 50’ wide strip running the length of the Brighton and Zumbach properties, approximately 213’, to the Brightons with the condition that said property be tied to the existing lot/lots and not be allowed to be transferred or used as a stand-alone lot, with a deed restriction/covenant making clear that the lot can only be used with said existing adjacent lots and cannot be used for the construction of any structure that is not tied to the existing lots, is appropriate and in the best interests of the City, and
WHEREAS, The Brighton’s initial offer for a larger parcel, 17,040 square feet, was $30,000 plus ½ of the survey costs, calculating out to $1.76 per square foot, which when applied to the smaller lot of approximately 10,650 square feet calculates to be $18,744, with the Brightons offering to purchase said reduced size lot at that rate and approximate cost, the final cost to be determined upon completion of a survey, with the costs of the survey to be split between the City and the Brightons on a 50/50 basis, and
WHEREAS, The Council finds that the City Administrator should prepare a purchase agreement between the City and the Brightons, setting out the above terms and thereafter order a survey of the property that will be necessary prior to transfer and closing on the property.
NOW THEREFORE BE IT RESOLVED by the City of Monticello, through its’ City Council, in session this 7th day of October, 2019 that the sale of the City property considered during tonight’s Public Hearing is hereby approved and the City Administrator is directed to proceed with the preparation of a purchase agreement after which he is to order a survey of the property consistent with this resolution prior to transfer and closing.
