IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA

RESOLUTION #18-30

Resolution approving and ratifying Council Direction to Purchase Tax Sale Certificate related to 103 W. 1st Street and to purchase owner’s interest in property
located at 103 W. 1st Street

WHEREAS, The City Council held a closed session during the regular Council meeting of February 5, 2018 during which the Council discussed the potential purchase of real estate where premature disclosure of the City interest in the property was deemed to likely increase the price the City would be required to pay for the property, and

WHEREAS, During said Closed Session the Council advised the City Administrator of the conditions of purchase that they would be amenable to before returning to open session and voting unanimously to direct the City Administrator to proceed with efforts to purchase the property within parameters discussed during the Closed Session, and

WHEREAS, As authorized and directed by the City Council the City Administrator took steps to obtain ownership of the property located at 103 W.1st Street, and

WHEREAS, The Council finds that the City Administrator was successful in his efforts to negotiate the purchase of the outstanding tax sale certificate as well as the owner’s interest in the property within the financial range discussed by the Council in closed session and that said actions should be approved and ratified by this Resolution.

NOW, THEREFORE, BE IT RESOLVED that the City Council of Monticello, Iowa does hereby approve and ratify the actions of the City Administrator in paying $2,000 for the assignment of the tax sale certificate associated with the property located at 103 W. 1st Street and $2,000 to Al Hughes in return for the sale of his interest in the property located at 103 W. 1st Street, said actions being consistent with the directives given the City Administrator during closed session that he was directed to follow by action of the Council in open session following said closed session.
