The City of Monticello, Iowa
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
RESOLUTION #17-67
Resolution to approve the request for sewer credits for 525 S Maple and 525 ½ S Maple Street.
WHEREAS, the City Council has determined that Yndia Hollins and/or Heather Freiburger, residents at 525 S. Maple Street, experienced a much higher than normal water/sewer billing as the result of a leak within the home, believed to be a leaky stool, and that the water entered the City Sanitary Sewer System, and
WHEREAS, the property at 525 S. Maple was being utilized as a duplex in violation of the Monticello City Code, with an upstairs and a downstairs apartment, the leaky stool causing the significant overage being located in one of the two units, and
WHEREAS, the home had been plumbed in such a fashion that all water, for both units, flowed first through one meter with water for the upstairs unit then flowing through a second meter, creating a higher than normal water/sewer bill for both units when the upstairs unit stool was leaking, and
WHEREAS, existing City Policy only allows a credit when it can be shown that the water leak did not flow into the City Sanitary Sewer System and when the calculated credit exceeded $100.00, and
WHEREAS, there is no evidence that the water did not flow into the Sanitary System and the illegal and inappropriately installed plumbing was the responsibility of the landlord, not the Ctiy.
NOW, THEREFORE, BE IT RESOLVED that the City Council of Monticello, Iowa does hereby deny the request for a sewer fee credit submitted by Yndia Hollins and Heather Freiburger in relation to the property located at 525 S. Maple Street, Monticello, Iowa.
