RESOLUTION #17-37
To approve proposed storm water cost share agreement between
City of Monticello and Theisen’s Inc.
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
WHEREAS, The City of Monticello Code of Ordinances provides for a storm water cost share when the proposed project is deemed by the City to be in the best interests of the City, and
WHEREAS, Theisen’s Inc. has submitted an Application for a Storm Water Cost Share related to a project with a total cost of approximately $16,000, requesting a cost share in the amount of $3,000, and
WHEREAS, The Council finds that a $3,000 investment in the proposed project is appropriate and in the best interests of the community, in that the project will help to preserve a downtown building and will divert rainwater from running over the sidewalk where ice could form to a tube/tile under the sidewalk and curb and gutter directly to the storm water catch basin on 1st Street, and
WHEREAS, The Council further finds that an Agreement should be drafted that requires Theisens to maintain and clear the tile installed as part of this project if and when cleaning of the tile is necessary, with Theisens being responsible for all costs associated with the cleaning and any and all related incidental costs including but not limited to street repairs associated therewith.
NOW THEREFORE BE IT RESOLVED by the City of Monticello, through its’ City Council, in session this 3rd day of April, 2017 that the proposed Storm Water Cost Share Agreement between the City of Monticello and Theisen’s Inc. is hereby approved, directs the City Administrator to put together a written agreement to provide that Theisens, or subsequent owner, shall be responsible for all costs associated with the cleaning and any and all related incidental costs including but not limited to street repairs associated therewith.
