IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
RESOLUTION # 16-86
Modifying fees previously set related to the Collection of Solid Waste pursuant to Chapter 106 of the Monticello Code of Ordinances
WHEREAS, the City Council previously set rates related to the collection of solid waste and recyclables by way of Resolution 15-101, and
WHEREAS, Resolution 15-101 provided for the application of discounts to senior citizens who met certain income qualifications, providing as follows:
H. Reduced Fees:
Any single person receiving services pursuant to this chapter shall be charged fifty percent (50%) of the current refuse collection charges and any married couple receiving services pursuant to this chapter shall be charged seventy-five percent (75%) of the current refuse collection charges, provided the following conditions are established:
1. The single person or at least one of the married couple is 65 years of age or older or is permanently disabled as determined by the Social Security Administration.
2. The single person or married couple jointly has an income from all sources of less than $10,000.00 per year.
3. Application for reduced fees shall be made in writing, at least five (5) working days prior to the commencement of the next billing cycle, and the applicant shall certify to the Clerk at the time of filing the application the applicant’s gross income and shall provide such further proof of eligibility as required by the Clerk.
4. Any person for whom application for reduced rates is approved shall receive one pickup per week.
and
WHEREAS, It has come to the attention of the City that the granting of discounts to one class of persons, in this case senior citizens meeting certain income qualifications, is likely in conflict with the Iowa Code, and
WHEREAS, The Council is informed and finds that only seven (7) current residents take advantage of the discounted rates, and
WHEREAS, The Council finds that the continuation of the practice of providing discounts to qualifying senior citizens should be discontinued.
NOW, THEREFORE, BE IT RESOLVED that the City Council of Monticello, Iowa does hereby approve the above and foregoing Resolution, eliminating the previously provided sanitation discounts for qualifying senior citizens, said change to be applied to the next Combined Utility Account invoice for services.
