IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
RESOLUTION # 15-48
Resolution approving transfer or exchange of City owned property adjacent to and north of Oakwood Cemetery to Mike Kraus in return for property adjacent to and east of Oakwood Cemetery from Mike Kraus
WHEREAS, the City Cemetery Board has proposed to the City Council that it is in the best interests of the City of Monticello to trade a parcel of property currently owned by the City lying north of the boundaries of the developed Oakwood Cemetery for a parcel of property lying adjacent to and east of the developed Oakwood Cemetery that is currently owned by Mike Kraus, and
WHEREAS, after appropriate notice in the Monticello Express a Public Hearing was held at tonight’s Council meeting, and
WHEREAS, the City Clerk reported that no prior written comment had been received at City Hall and the Council considered public comment from Gerald Muller during the public hearing, and
WHEREAS, it is proposed that the parcels to be traded without additional consideration between the parties, with the understanding that the City will cover survey costs associated with this transaction, and
WHEREAS, the parcels have been set out by a professional land surveyor and disclose that the parcel to be transferred by the City to Kraus totals 4.15 acres more or less, same also including a rocky portion that is not amenable to farming, and the parcel to be transferred by Kraus to the City totals 4.17 acres, and
WHEREAS, the Cemetery Board has recommended that this transaction be approved as being in the best interests of the Cemetery, and the Council finds that said transaction does appear to be in the best interest of the City and that same should, therefore, be approved with the understanding that the City of Monticello be given a right of first refusal to purchase the parcel being transferred to Kraus should Kraus, or any successor in interest, offer to sell said parcel at any future date.
NOW, THEREFORE, BE IT RESOLVED that the City Council of Monticello, Iowa does hereby approve of the proposed transfer/exchange of the above-identified parcels with the understanding that the City will cover costs of surveying and that Kraus will grant the City a right of first refusal as previously set forth herein.
