IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
RESOLUTION #15-110
Approving Lease Agreement between the
City of Monticello and Mike Kraus
with regard to the “farm” ground located at the Oakwood Cemetery
WHEREAS, the City of Monticello has leased ground to Mike Kraus at the Cemetery for a great number of years, and
WHEREAS, The City and Mike Kraus have recently agreed to a land swap of certain grounds at the Oakwood Cemetery, resulting in the City taking ownership of a parcel, when combined with other Cemetery grounds, creates a six (6) acre parcel of ground that may be farmed, and
WHEREAS, Mike Kraus previously rented Cemetery ground at the rate of $75.00/acre with the understanding that it had to be maintained in hay, absent agreement of the Board, and has agreed to pay the sum of $500.00 per year or approximately $83.34 per acre for the approximate six (6) acre parcel with the understanding that he will continue to be limited to the use of said ground for hay, absent Board approval, and
WHEREAS, The proposed lease is for a term of one year and said grounds are immediately adjacent to Kraus owned and farmed ground, and
WHEREAS, The Cemetery Board previously agreed to rent said grounds to Kraus for the current year and has not taken action to terminate said lease.
NOW, THEREFORE, BE IT RESOLVED that the City Council of Monticello, Iowa does hereby approve of the entry into the proposed one (1) year lease agreement between the City of Monticello and Mike Kraus at the annual rental rate of $500, and directs the Mayor to execute the lease on behalf of the City Council and further directs the City Administrator to obtain the signature of Mike Kraus as tenant.
