The City of Monticello, Iowa
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
RESOLUTION #14-56
Resolution to request Abatement of accrued Property Taxes on properties owned by the City of Monticello for public purposes within the City limits of the City of Monticello.
WHEREAS, The City of Monticello owns the properties located at 112 E. 1st Street, 114 E. 1st Street, and 117 E. Grand Street, all in Monticello, Iowa, all of same being acquired after the downtown Monticello fire of November, 2011, all of same being purchased by the City for purposes of City improvements as part of the downtown fire re-development, and
WHEREAS, The City of Monticello also owns the property located at 511 E. Oak Street (This property has on occasion, in certain public records, been inaccurately referred to as 511 S. Oak Street), same being acquired as part of a FEMA supported flood buy-out, said property to be used with other adjacent properties for public park purposes, and
WHEREAS, The Tax Parcel ID’s for the above properties are as follows:
112 E. 1st Street (0227101006)
114 E. 1st Street (0227101007)
117 E. Grand Street (0227101016)
511 S. Oak Street (0227130014; 0227130016)

WHEREAS, The Purchase Agreement between the City of Monticello and Dale and Joan Chally, prior owner of 117 E. Grand Street, required that Chally pay the real estate taxes accruing through 12/30/12, said payment being due and payable in September, 2013, with the City accepting responsibility for all taxes that accrued after that date, receiving no money from Chally related to the pro-ration of accrued real estate taxes, and
WHEREAS, The City purchased the Chally property to see to its’ demolition or removal for purposes of a City Parking lot to assist the downtown businesses and post 2011 fire redevelopment, and
WHEREAS, The City was given the property at 112 E. 1st Street by KIJI Ltd., with no consideration, after the demolition and removal of the building by KIJI, Ltd., after the 2011 fire, and
WHEREAS, The City agreed to accept the KIJI property with the understanding that KIJI would not pay any accrued taxes to the treasurer or by way of a tax pro-ration payable to the City, and that the City would release a lien, in favor of the City, previously placed on the property related to utility usage by a past tenant of the building, and
WHEREAS, The City also agreed to accept ownership of the property located at 112 E. 1st Street from Thomas and Teri Keleher, in return for the sum of $3,000, said sum being paid by two $1,500 donations received by the City for that purpose, and
WHEREAS, The City took ownership of the property located at 112 E. 1st Street on 12/27/2013 with taxes being pro-rated through that date and paid to the Jones County Treasurer, and
WHEREAS, The City has acquired all of the above described properties in order to improve the community of Monticello and Jones County, said properties to be converted to public uses to assist and/or bring about the redevelopment of the downtown, and to remove structures from the flood plain, converting said area to a park environment, and
WHEREAS, The Council finds it appropriate, under the circumstances, to not pay any of the accrued taxes, whether past due or accrued and not yet due, and to so inform the County Treasurer so that the County Board of Supervisors can take action to formally abate said taxes as required by§445.63 of the Iowa Code.
NOW, THEREFORE, BE IT RESOLVED that the City Council of Monticello, Iowa does hereby direct the City Clerk to inform the County Treasurer of the decision of the City Council to not pay any and all taxes past due and/or accrued prior to the date of the City ownership of those properties previously identified herein and to request that the County Board of Supervisors abate said taxes as required by§445.63 of the Iowa Code.
