HEARING ON 2013 AMENDMENT TO THE MONTICELLO URBAN RENEWAL PLAN

The City Council of the City of Monticello, Iowa, met on December 16, 2013, at 6:00 o’clock, p.m., during a regularly scheduled City Council meeting in the Council Chambers for the purpose of conducting a public hearing on a proposed urban renewal plan amendment. The Mayor presided and the roll being called the following members of the Council were present and absent:
Present: Dave Goedken, Bill Meyer, Frank Yanda, John Sauser, Chris Lux and Tom Yeoman.
Absent: None.
The Council investigated and found that notice of the intention of the City Council to conduct a public hearing on the urban renewal plan amendment had been published according to law and as directed by the Council and that this is the time and place at which the Council shall receive oral or written objections from any resident or property owner of the City. All written objections, statements, and evidence heretofore filed were reported to the Council, and all oral objections, statements, and all other exhibits presented were considered.
The following named persons presented oral objections, statements, or evidence as summarized below; filed written objections or statements, copies of which are attached hereto; or presented other exhibits, copies of which are attached hereto:

There being no further objections, comments, or evidence offered, the Mayor announced the hearing closed.
Council Member Goedken moved the adoption of a resolution entitled “A resolution approving the 2013 amendment to City of Monticello Urban Renewal Plan”, seconded by Council Member Yanda. After due consideration, the Mayor put the question to a roll call vote, with the following votes cast:
Ayes: Goedken, Yanda, Meyer, Sauser, Lux and Yeoman.
Nays: None.
Whereupon, the Mayor declared the resolution duly adopted and signed approval thereto.
RESOLUTION NO. 13-108
Resolution approving the 2013 amendment to the City of Monticello
Urban Renewal Plan
WHEREAS, as a preliminary step to exercising the authority conferred upon Iowa cities by Chapter 403 of the Code of Iowa (the “Urban Renewal Law”), a municipality must adopt a resolution finding that one or more slums, blighted or economic development areas exist in the municipality and that the rehabilitation, conservation, redevelopment, development or a combination thereof, of such area or areas is necessary in the interest of the public health, safety or welfare of the residents of the municipality; and
WHEREAS, this Council has previously created the Monticello Urban Renewal Area (the “Urban Renewal Area”); and
WHEREAS, an amendment to the Urban Renewal Plan has been prepared to specify a project that the City Council intends to utilize tax increment financing dollars to finance, and
WHEREAS, notice of a Public Hearing to be held before the City Council on the proposed urban renewal plan amendment for the Monticello Urban Renewal Area was heretofore given in strict compliance with the provisions of Chapter 403 of the Code of Iowa, and the Council has conducted said hearing; and
WHEREAS, the proposed urban renewal plan amendment was previously submitted to the planning and zoning commission of the City of Monticello for review and comment; and
WHEREAS, copies of the urban renewal plan amendment, notice of public hearing and notice of a consultation meeting with respect to the urban renewal plan amendment were mailed to the Jones County Board of Supervisors and the Monticello Community School District; the consultation meeting being held on the 4th day of December, 2013; no comments in opposition to the amendment or recommendations related thereto were received.
NOW, THEREFORE, be it Resolved by the City Council of the City of Monticello, Iowa, as follows:
Section 1. The proposed amendment to the urban renewal plan for the Monticello Urban Renewal Area, attached hereto and made a part hereof by this reference as if set forth fully verbatim herein, is hereby approved in all respects;
Section 2. All resolutions or parts thereof in conflict herewith are hereby repealed to the extent of such conflict.

URBAN RENEWAL PLAN AMENDMENT
MONTICELLO URBAN RENEWAL AREA

The Urban Renewal Plan (the “Plan”), for the Monticello Urban Renewal Area (the “Area”), is being amended for the purpose of identifying a new urban renewal project to be undertaken therein.
1) Identification of Projects.
By virtue of this amendment, the list of authorized urban renewal projects in the Plan is hereby amended to include the following project description:
Name of Project: Downtown Parking Lot Improvement Project (the “Parking Lot Project”)
Name of Urban Renewal Area: Monticello Urban Renewal Area
Year of Establishment of Urban Renewal Area: October 19, 1992
Date of Council Approval of Project: November 18, 2013
Location and Description of Parking Lot Project: The project is proposed to include the acquisition of real property situated at 117 East Grand Street in the Urban Renewal Area, the demolition of all structures on said property, and the construction of a municipal parking lot and reconstruction of existing alleyways associated therewith. The project is also proposed to include the acquisition of real property located at 114 E. 1st Street and the demolition of the structure located thereon, and the acceptance of the property located at 112 E. 1st Street, as a gift to the City, and the construction of a walkway/steps, green-space area to facilitate foot traffic from the Municipal Parking Lot to the downtown Commercial District within the bounds of the properties identified as 112 and 114 E. 1st Street. The parking lot will provide parking spaces for commercial enterprises situated in the City’s downtown.
Description of Properties to be Acquired in Connection with Project: The City will acquire the Parking Lot Property (the “Real Estate Acquisition”) and such easement territory and right-of-way as are necessary to successfully undertake the Parking Lot Project. The City will also acquire, by gift, the vacant property located at 112 E. 1st Street and the property, and structure, located at 114 E. 1st Street for the sum of $3,000, with $3,000 being donated to the City to cover the acquisition cost.
Description of Use of TIF: It is anticipated that the City will pay for the Parking Lot Project, including the Real Estate Acquisition and all demolition related expenses from either borrowed funds or the proceeds of an internal advance of City funds on-hand. In either case, the City’s obligation will be repaid with incremental property tax revenues. It is anticipated that the City’s use of incremental property tax revenues for the Parking Lot Project will not exceed $200,000.
2) Required Financial Information. The following information is provided in accordance with the requirements of Section 403.17 of the Code of Iowa:
Constitutional debt limit of the City: $9,582,865
Outstanding general obligation debt of the City: $5,125,000
