The City of Monticello, Iowa
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
RESOLUTION # 12-99
Approving Bid and Contract with Justice Electric Company to install natural gas / propane Generator consistent with bid specifications, bid notices, and bid received by the City from Justice Electric, with the understanding that the additional cost related to the gas line installation would not exceed $1,600, and that they would cover all costs, in excess of $150.00, related to the placement of the generator on the generator pad and would sign an agreement to that effect
WHEREAS, The City requested bids to install a generator at the Monticello Emergency Response Center, and
WHEREAS, The City previously borrowed funds for the purposes of installing a generator at the ERC, and
WHEREAS, Three bids were received after publication of two notices in the Monticello Express requesting bids, bids being received and opened on June 29, 2012 at approximately 4:00 p.m. by City Administrator Doug Herman, with Councilman Tom Yeoman also being present, the bids being in the following amounts:
1. Justice Electric Company: $ 4,750.00
2. REM Electric: $ 7,328.49
3. DeLancey Electric: $14,938.66

WHEREAS, The Council finds that the Justice Electric bid did not cover the “setting” of the generator as was requested by the bid specifications while the other bids included the setting of the generator, and
WHEREAS, The Council further finds that L.J. Takes, a local electrician and crane operator has agreed to set the generator at the rate of $150.00 per hour and it is the opinion of the City Administrator after discussions with L.J. Takes that the placement of the generator should not be a long drawn out affair, and that the total additional cost to set the generator should not exceed $450.00, and
WHEREAS, The Council finds that the bids should be accepted, with the low bidder, Justice Electric being awarded the bid with the understanding that they will enter into a written agreement with the City acknowledging their obligations and setting out the relationship between the parties as Independent Contractor (Justice) and Customer (City), with the City hiring L.J. Takes to set the generator at the sole cost of the City.
NOW, THEREFORE, BE IT RESOLVED that the City Council of Monticello, Iowa does hereby accept the bids received and does hereby award the project to Justice Electric with the understanding that Justice Electric will enter into the City of Monticello Independent Contractor agreement acknowledging the rights and responsibilities of the parties and the relationship of the parties, that being Independent Contractor and customer.
