IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
RESOLUTION #12-143
Resolution to amend Resolution #12-105 with regard to 2nd Street Assessments.
WHEREAS, the City of Monticello approved and filed Resolution 12-105 confirming and levying the special assessments, directing the certification of same to the County Treasurer, same being approved on July 16, 2012, and
WHEREAS, subsequent to the beginning of our assessment process, but before the approval of Resolution #12-05, the State Legislature passed amendments to Iowa Code Section 364.13, signed into law on May 25, 2012, modifying language that previously permitted assessments of greater than $100.00 to be to collected in ten installments through the County Treasurer’s Office (see Iowa Code 364.13 Installments), by increasing the minimum amount from $100 to $500, and
WHEREAS, the amended law took affect on July 1, 2012, and
WHEREAS, Based upon the amendment, the Council must approve a Resolution amending Resolution #12-105 by amending “Section 4” of the Resolution to read, “Each of such assessments in the amount of Five Hundred Dollars ($500.00) or more is hereby divided into 10 equal installments, as near as may be.” and by amending “Section 8” to read, “All assessments in the amount of less than five hundred dollars ($500.00) shall become due and payable in full on the first day of July 2013.”, and finally, the City Clerk shall be directed to notify all of those impacted by the change in the Iowa Code who previously were told that they could pay the assessment over ten (10) years who now must pay the assessment by July of 2013.
NOW, THEREFORE, BE IT RESOLVED that the City Council of Monticello, Iowa does hereby amend Resolution #12-105 by amending “Section 4” of the Resolution to read, “Each of such assessments in the amount of Five Hundred Dollars ($500.00) or more is hereby divided into 10 equal installments, as near as may be.” and by amending “Section 8” to read, “All assessments in the amount of less than five hundred dollars ($500.00) shall become due and payable in full on the first day of July 2013.”, and finally, the City Clerk is hereby directed to notify all of those impacted by the change in the Iowa Code who previously were told that they could pay the assessment over ten (10) years who now must pay the assessment by July of 2013.
