IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
RESOLUTION #11-99
Resolution to request Abatement of accrued taxes at Riddle Property, 615 E. Washington Street, Monticello, IA, 52310.
WHEREAS, The City of Monticello is the owner of the property located at 615 E. Washington Street, Monticello, Iowa, former site of Riddle Manufacturing, and
WHEREAS, Taxes for tax year 2009 accrued on said property prior to the City ownership of the building in May of 2011, said taxes being subject to tax sale in June of 2011, in the approximate amount of $5,100, ($2,550 being due for the 1st half of 2009, Jan. 1, 2009 through June 30, 2009 and $2,550 being due for the 2nd half of 2009, July 1, 2009 through Dec. 31, 2009), and
WHEREAS, Additional taxes would also have accrued for 2010 and a portion of the first ½ of 2011, with taxes for the first half of 2010 being due in March 2011, taxes for the second half of 2010 being due in September 2010, and taxes for the period of Jan. 1, 2011 through the date of City ownership, May 9, 2011, being due in March, 2012, and
WHEREAS, When the City accepted ownership of the Riddle Building the City did not receive any pro-rated taxes from Mr. Riddle, the property taxes having been sold on two prior occasions. The city has spent approximately $13,250 on asbestos removal (1/2 of total cost with IDNR paying other ½), $500 on an asbestos project design, $900 on an abstract update, $10,000 on demolition, $9,000 on the settlement of prior tax sales, and will spend approx. $3,500 on the removal of the Underground Storage Tank, which should be reimbursed by the State UST Removal fund, with an approximate total City investment, assuming reimbursement from the State for the UST removal, in the amount of $33,650 related to the Riddle property, and
WHEREAS, The City acquired the Riddle property to rid the City of a contaminated, nuisance and dilapidated structure located in the floodway and flood plain and will not profit financially from the acquisition of said property, and
WHEREAS, The Council finds it appropriate, under the circumstances, to not pay any of the accrued taxes, whether yet due or not, and to so inform the County Treasurer for action to abate said taxes by the County Board of Supervisors as required by the Iowa Code.
NOW, THEREFORE, BE IT RESOLVED that the City Council of Monticello, Iowa does hereby direct the City Clerk to inform the County Treasurer of the decision of the City Council to not pay any and all taxes accrued prior to the date of the City ownership of the Riddle Property (MONCO Parcel Number 0227129020) and to request that the County Board of Supervisors abate said taxes as required by the Iowa Code.
