THE CITY OF MONTICELLO, IOWA
RESOLUTION #11-88
Resolution to approve 28E Agreement between Jones County and the City of Monticello with regard to the Hardscrabble Road project.
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
WHEREAS, The City previously approved a “Project Agreement” between the City and Jones County by Resolution #11-66, and
WHEREAS, The County did not approve of said “Project Agreement”, and
WHEREAS, Resolution #11-66 approving the referenced “Project Agreement” is hereby rescinded and of no force and effect, and
WHEREAS, The County has proposed a 28E Agreement in lieu of the Project Agreement, and
WHEREAS, The Council has considered the terms of the 28E agreement as proposed, and finds that same should be approved, subject to the following changes:
1. The City share should be 28% as noted in the agreement, or $140,000, the amount budgeted by the City for this project, whichever is less.
2. The agreement should make clear that the project “costs” being shared do not include any engineering or construction supervision, those responsibilities and any costs related thereto being the responsibility of the county.
and
WHEREAS, the City Council finds that the proposed agreement as amended should be forwarded to the County Board of Supervisors for consideration, and the City Administrator is directed to attend the County Board of Supervisors meeting at their request to answer any and all questions they may have with regard to the amendments proposed and approved by the City Council.
NOW THEREFORE BE IT RESOLVED by the City of Monticello, through its’ City Council, in session this 6th day of June, 2011, that the 28E Agreement related to the Hardscrabble Road project, between Jones County and the City of Monticello, as amended is fair and appropriate and the Mayor Pro Tem is hereby authorized to execute same on behalf of the City Council.
