The City of Monticello, Iowa
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
RESOLUTION #11-79
Approving Stadtmueller request for reduction in sanitary sewer fees
related to water line break.
WHEREAS, Melvin Stadtmueller suffered a water line break at his property located at 318 West Third Street, Monticello, Iowa, resulting in substantial property damage, and
WHEREAS, The water line break also resulted in a large water and sewer bill with the City of Monticello, and
WHEREAS, The Council finds, based upon a review of the property by Public Works Director Diz Edwards, that the leaking water worked its’ way from the point of the break on the second floor, through the first floor, down to the basement, where what water that did not soak into something drained through a floor drain to the Sanitary Sewer System, and
WHEREAS, Mr. Stadtmueller has requested that the Council consider waiving some portion of the sanitary sewer bill in light of the fact that some of the water that leaked was soaked up by carpet, furnishings, and the like, and did not actually make it into the sanitary sewer system, and
WHEREAS, The Council finds that the granting of a credit in this situation would be in conflict with past practices and policy, would be difficult to calculate, and that the homeowner’s insurance should cover this expense as part and parcel of the overall loss.
NOW, THEREFORE, BE IT RESOLVED that the City Council of Monticello, Iowa in session this 16th day of May, 2011, does hereby deny the request for a credit against the utility account related to the property located at 318 West Third Street, Monticello, Iowa owned by Melvin Stadtmueller.
