THE CITY OF MONTICELLO, IOWA
RESOLUTION #11-62
Resolution setting forth intent to assign City rights in and to a certain purchase agreement by and between the City of Monticello and Kirkwood Community College, to Joel and Leslie Althoff, or successor entity.
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
WHEREAS, The City Council has explored many options related to the future of the John McDonald Hospital Building, a/k/a the old “Kirkwood” Building with the primary goal being to maintain Four Oaks as a business and school resident of the City of Monticello, and incidental or supplemental goal of maintaining the building in an occupied and useful state for the overall betterment of the community, and
WHEREAS, The exploration of options has included the outright City ownership of the structure with the potential entry into a rental agreement between the City of Monticello and Four Oaks and/or the potential transfer of the property to a private developer willing to work with Four Oaks on a lease agreement and further willing to designate space within the facility for purposes of a Monticello Senior Center, and
WHEREAS, The City, after much discussion and negotiation, has entered into a purchase agreement with Kirkwood whereby Kirkwood has agreed to transfer the property to the City of Monticello for $1.00, with the City being entitled to transfer and assign its’ interest in and to said purchase agreement, and has further determined it appropriate and desirable to transfer and assign the City interest in and to said purchase agreement as provided therein, to Joel and Leslie Althoff, or successor entity, for the sum of $50,000, payable to the City of Monticello, and
WHEREAS, To ensure compliance with Iowa Code §364.7 “Disposal of Property”, the City Council finds that a Public Hearing should be set on the proposed Assignment of the City’s interest in its’ purchase agreement with Kirkwood Community College, and finds that same should be set for Wednesday May 11th, at 5:30 p.m., to be held at the Monticello Renaissance Center, City Council Chambers on that date and time.
NOW THEREFORE BE IT RESOLVED by the City of Monticello, through its’ City Council, in session this 2nd day of May, 2011, that a Public Hearing on the proposed Assignment of the City’s interest in its’ purchase agreement with Kirkwood Community College is hereby set for Wednesday May 11th, at 5:30 p.m. in the City Council Chambers at the Monticello Renaissance Center; notice of said public hearing shall be published as required by §364.7 of the Iowa Code.
