RESOLUTION #11-47
Resolution approving of and authorizing entry into Purchase Agreement with Acreage Habitat Services LLC for Wetland Mitigation Bank Credits, said agreement to result in the satisfaction of the City’s Wetland Mitigation obligations related to the
Sewage Treatment Plant Levee.
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
WHEREAS, The City of Monticello has been involved in the construction of a levee around the Monticello Sewage Treatment Plant to protect the plant from the future flooding of the Maquoketa River, and
WHEREAS, A portion of the Levee has been determined by the Corps of Engineers to be located on or within a wetland, and
WHEREAS, Due to the Corps determination that a wetland has been impacted, the City is under an obligation to “mitigate” the impact, with one of the options being to purchase mitigation credits from a Corps approved mitigation bank, and
WHEREAS, The City has considered its’ options, from creating a wetland locally, to purchasing credits through a Mitigation Bank, and has determined it to be in the best interests of the City to purchase credits through Acreage and Habitat Services, LLC, as proposed and approved by the Corps of Engineers and the Iowa DNR, and as set out in a Purchase Agreement, a copy of same being attached hereto, for the sum of $140,700.
NOW THEREFORE BE IT RESOLVED by the City of Monticello, through its’ City Council, in session this 4th day of April, 2011, that the best interests of the City would be served by purchasing Wetland Mitigation Bank Credits to meet the City’s obligation to mitigate wetland impact created by the construction of the sewage treatment plant levee, and does hereby authorize the Mayor Pro Tem to execute the proposed Purchase Agreement with Acreage and Habitat Services LLC in the amount of $140,700, and does further authorize the City Clerk to see to the payment of said sum to Acreage and Habitat Services by May 8, 2011, contingent upon formal approval and execution of the purchase agreement by the Corps of Engineers and the Iowa DNR, said payment to be made from General Fund cash, to be reimbursed by bond proceeds to be received at some point over the next few months.
