The City of Monticello, Iowa
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
RESOLUTION # 11- 156
Setting forth position and policy of City Council that the properties located at 100 W. 11th Street, Koob Automotive, and 22073 Hwy. 38, Monticello Machine Shop, must agree to the voluntary annexation of their properties in return for the agreement of the City to allow said properties to connect to the City Water system.
WHEREAS, The Northern boundary of the City of Monticello generally runs along the center line of 11th Street, and
WHEREAS, The properties located at 100 W. 11th Street, Koob Automotive, and 22073 Hwy. 38, Monticello Machine Shop lie just to the North of the current City boundaries, and
WHEREAS, Both of the above-referenced properties desire to be connected to and billed for City water and a City water main extends along the eastern boundaries of said properties, and
WHEREAS, The owners of both of the above-referenced properties have been approached and discussions have occurred in regard to the annexation of their properties, and
WHEREAS, The past practice of the City has been to require a property owner to enter into a voluntary annexation agreement in return for the allowance of City Water.
NOW, THEREFORE, BE IT RESOLVED that the City Council of Monticello, Iowa does hereby determine and set forth their decision, that the policy of the City is that any property owner desirous of connecting to the City Water Main must agree to the voluntary annexation of their property by way of a written voluntary annexation agreement with the City; that such a policy is in the best interests of the City of Monticello, Iowa.
