RESOLUTION #11-154
Resolution to schedule Public Hearing on the Demolition of the structures, foundation, and other remaining improvements on the property commonly described as 301 E. Third Street, and leveling of the lot, for Monday November 14, 2011 at 6:00 p.m. at the Renaissance Center / Council Chambers.
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
WHEREAS, The City Administrator is ultimately responsible for the enforcement of Chapter 50 “Nuisances”, Chapter 145 “Dangerous Buildings”, and Chapter 153 “Property Maintenance”, all part of the Monticello Code of Ordinances, and
WHEREAS, The City Administrator has repeatedly informed the owner of property located at 301 E. Third Street, Monticello, Iowa of the violations of those Chapters and has discussed the violations with a representative of the owner by phone on two occasions, and
WHEREAS, By letter to the owner dated August 9th, the administrator advised the owner that a public hearing would be held on August 15th shortly after 6:00 p.m. during the regularly scheduled City Council meeting, and that the owner would on that date and time have an opportunity to present evidence and to contest the allegations related to the condition of the property as presented or alleged by the City and to further contest the potential demolition of the property, however, no one appeared on behalf of the owner, and
WHEREAS, The City Administrator represented the City in regard to a civil citation issued by the Administrator with the approval of the City Council in Magistrate’s Court on November 2, 2011, with a judgment to be issued shortly, and
WHEREAS, the City Administrator mailed a follow up letter to the Civil Citation hearing to the owner, said letter dated November 3, 2011 and mailed by regular and certified mail, outlining the plan to see to the demolition of all structures, foundations, etc. on the property between November 15-18, 2011, with the costs of same to be assessed to the owner and/or then the property for payment and further notified the owner that a hearing could be requested in writing on said determination and plan so long as the written request was postmarked to the City of Monticello by no later than November 10, 2011, and that if a hearing were requested it would be held on November 14, 2011 at 6:00 p.m. in the Monticello Council Chambers, and
WHEREAS, the City Council finds it appropriate to schedule a special meeting for November 14th, 2011 at 6:00 p.m., the meeting to only be held if the City Administrator receives a written request for a hearing from the owner with a postmark mailing date of on or before November 10, 2011.
NOW THEREFORE BE IT RESOLVED by the City of Monticello, through its’ City Council, in session this 7th day of November, 2011, that a Special Meeting of the Monticello City Council is hereby scheduled for the 14th day of November with the sole purpose of holding a public hearing related to the potential demolition by the City of the structures and improvements located on the property commonly known as 301 E. Third Street, Monticello, IA, should the owner of said property, Nationwide Advantage Mortgage Company request said hearing in writing by postmarked request to the City of Monticello by November 10, 2011.
