The City Council of the City of Monticello, Iowa, met on October 3, 2011, at 6:00 o’clock, p.m., at the Mary Lovell LeVan, Monticello Renaissance Center, Community Media Center, 220 East First Street, in the City for the purpose of conducting a public hearing on the designation of an urban renewal area and on a proposed urban renewal plan amendment. The Mayor Pro Tem presided and the roll being called the following members of the Council were present and absent:
Present: Gerald Muller, Gregg Merfeld, Chris Lux, Tom Yeoman and John Sauser.
Absent: Dave Goedken.
The City Council investigated and found that notice of the intention of the Council to conduct a public hearing on the designation of the 2011 Addition to the Monticello Urban Renewal Area and on an urban renewal plan amendment had been published according to law and as directed by the Council and that this is the time and place at which the Council shall receive oral or written objections from any resident or property owner of the City. All written objections, statements, and evidence heretofore filed were reported to the City Council, and all oral objections, statements, and all other exhibits presented were considered.
The following named persons presented oral objections, statements, or evidence as summarized below; filed written objections or statements, copies of which are attached hereto; or presented other exhibits, copies of which are attached hereto:

There being no further objections, comments, or evidence offered, the Mayor Pro Tem announced the hearing closed.

The City Council of the City of Monticello, Iowa, met on October 17, 2011, at 6:00 o’clock, p.m., at the Mary Lovell LeVan, Monticello Renaissance Center, Community Media Center, 220 East First Street, in the City for the purpose of considering the adoption of a resolution to declare necessity and establish an urban renewal area, pursuant to Section 403.4 of the Code of Iowa and approve urban renewal plan amendment for the 2011 Addition to the Monticello Urban Renewal Area”. The Mayor Pro Tem presided and the roll being called the following members of the Council were present and absent:
Present: Dave Goedken, Gerald Muller, Gregg Merfeld, Chris Lux, and John Sauser.
Absent: Tom Yeoman.
Council Member Goedken moved the adoption of the Resolution of Necessity and the motion was seconded by Council Member Muller. After due consideration, the Mayor Pro Tem put the question on the motion and the roll being called, the following named Council Members voted:
Ayes: Goedken, Muller, Sauser, Lux and Merfeld.
Nays: None
Whereupon, the Mayor Pro Tem declared the resolution duly adopted and signed approval thereto.
RESOLUTION NO. 11-146
A resolution to declare necessity and establish an urban renewal area, pursuant to Section 403.4 of the Code of Iowa and approve urban renewal plan amendment for the 2011 Addition to the Monticello Urban Renewal Area
WHEREAS, as a preliminary step to exercising the authority conferred upon Iowa cities by Chapter 403 of the Code of Iowa (the “Urban Renewal Law”), a municipality must adopt a resolution finding that one or more slums, blighted or economic development areas exist in the municipality and that the development of such area or areas is necessary in the interest of the public health, safety or welfare of the residents of the municipality; and
WHEREAS, the City Council (the “Council”) of the City of Monticello (the “City”) has previously created the Monticello Urban Renewal Area (the “Urban Renewal Area”); and
WHEREAS, a proposal has been made which shows the desirability of expanding the Urban Renewal Area to add and include all the property within the legal description set out in Exhibit “A” hereto; and
WHEREAS, the proposal demonstrates that sufficient need exists to warrant finding the area shown in Exhibit “A” to be an economic development area; and
WHEREAS, notice of a public hearing by the City Council of the City on the question of establishing the area shown in Exhibit “A” hereto as an urban renewal area and on a proposed urban renewal plan amendment for the 2011 Addition to the Monticello Urban Renewal Area was heretofore given in compliance with the provisions of Chapter 403 of the Code of Iowa, and the Council has conducted said hearing; and
WHEREAS, the Planning and Zoning Commission of the City has reviewed and commented on the proposed urban renewal plan amendment; and
WHEREAS, copies of the urban renewal plan amendment, notice of public hearing and notice of a consultation meeting with respect to the urban renewal plan amendment were mailed to Jones County, Monticello Community School District and Kirkwood Community College; the consultation meeting was held on Wednesday the 28th day of September, 2011 at 3:00 p.m.; no one appeared to comment at said consultation meeting, and, therefore, no response to said entities was required by the City;
NOW, THEREFORE, It Is Resolved by the City Council of the City of Monticello, Iowa, as follows:
Section 1. An economic development area as defined in Chapter 403 of the Code of Iowa, is found to exist in the City of Monticello within the boundaries set out in Exhibit “A” hereto.
Section 2. The area identified in Section 1 hereof is hereby declared to be an urban renewal area, in conformance with the requirements of Chapter 403 of the Code of Iowa, and is hereby designated the 2011 Addition to the Monticello Urban Renewal Area.
Section 3. The development of this area is necessary in the interest of the public health, safety or welfare of the residents of the City.
Section 4. The amendment to the urban renewal plan for the Monticello Urban Renewal Area incorporating this area is attached hereto and identified as Exhibit “B”. By this reference, said document is in all respects approved and incorporated within this Resolution as if set forth fully, verbatim, herein.
Section 5. All resolutions or parts thereof in conflict herewith are hereby repealed, to the extent of such conflict.

The John McDonald Hospital building property located at 818 W. 1st Street, Monticello, Iowa, legally described as follows:
PARCEL E, located in the SE ¼ SW ¼ of SECTION 21, TOWNSHIP 86 NORTH, RANGE 3 West of the 5th P.M., as shown in the PLAT OF SURVEY recorded in PLAT BOOK J, PAGE 104 (and in BOOK 314, PAGE 181) of the Jones County, Iowa records, containing 2.14 acres, inclusive of 0.02 acre public highway.
SUBJECT TO the rights of the public in all highways, and to all easements and agreements of record.

The Innovative Ag. Services property located at 2010 S. Main Street, Monticello, Iowa, legally described as follows:
That portion of the SE ¼ of SECTION 33, TOWNSHIP 86, NORTH, RANGE 3, West of the 5th P.M., Jones County, Iowa, described as Commencing at a point 573.1 feet North of the Southeast corner of said Section 33; thence South 8935’ West 986.0 feet to the Easterly right of way line of former U.S. Highway No. 151; thence North 4754’ East 1,328.8 feet along said right of way line to the East line of the NE ¼ SE ¼ of said Section 33; thence South 883.7 feet along the East line of said Section 33 to the point of beginning. The East line of said Section 33 is assumed to bear due North and South.
IN ADDITION TO THE FOLLOWING PUBLIC STREET RIGHT-OF WAYS:
West 1st Street, from its’ intersection with Gill Street extending in a westerly direction to the Monticello city limits. AMENDMENT
URBAN RENEWAL PLAN
MONTICELLO URBAN RENEWAL AREA
September, 2011
The urban renewal plan for the Monticello Urban Renewal Area, is being amended to increase the size of the district. The area to be added to the Urban Renewal Area is illustrated as set forth within Exhibit A and described in Exhibit B, both attached hereto.
If the proposed Ordinance, incorporating and addressing this amendment is adopted during calendar year 2011, and if debt payable from incremental taxes is certified to the County Auditor by December 1, 2011, the area being added to the district as a result of this amendment will have a “frozen base’ as of the January 1, 2010 valuation date.
The adoption of this plan amendment will result in the additional area being designated as an “Economic Development Area”, desirable for the promotion of economic development. The new area will also be subject to the terms and provisions of the original plan. In addition to those purposes set out in the original urban renewal plan, as subsequently amended, this amendment will add to the plan the use of tax increment financing for the following proposed projects:
1). The provision of economic development incentives to the owner of the John McDonald Hospital property.
2). The provision of economic development incentives to the owner(s) / shareholders of the IAS (Innovative Ag. Services, Inc.) property.
3). The repair or reconstruction of streets identified within the ROW’s identified by the proposed amendment, including West 1st Street, from its’ intersection with Gill Street extending in a westerly direction to the Monticello city limits; Grandview Avenue from and including its intersection with Gill Street to and including its intersection with Park Drive; Alta Vista Avenue from and including its intersection with Gill Street to and including its intersection with Park Drive.
