IN THE NAME AND BY THE AUTHORITY OF THE CITY OF MONTICELLO, IOWA
RESOLUTION #11-13
Approving Horsfield Construction Co. Final Pay Request in the amount of $98,958.31 related to the South Cedar Street Reconstruction project.
WHEREAS, The City of Monticello, Iowa is an incorporated City within Jones County, Iowa; and
WHEREAS, The City of Monticello selected Horsfield Construction as the contractor for the South Cedar Street Reconstruction project; and
WHEREAS, The City Engineer has submitted a letter to the City certifying that the project has been completed in substantial conformance with the plans and specifications and has recommended that final payment be made to Horsfield in the amount of $98,958.31, with the City continuing to hold retainage in the amount of $71,122.74; and
WHEREAS, The City Council finds that the work should be accepted as complete, and that based thereon, the Engineer should be directed to prepare the final plat and schedule of assessments related to this project; and
WHEREAS, The City Council directs the City Engineer, in preparation of the final assessments plat and schedule of assessments to calculate the assessments for sidewalk to benefitted properties based upon the installation of a standard 4’ sidewalk, not the 5’ or 6’ sidewalks that were installed on this project, and further directs the engineer to calculate said assessments based upon the following numbers: $3.25 sf for driveways, $3.00 sf for sidewalks, and $14.00 per lineal foot of frontage for curb and gutter, same being identical to the assessments calculated during the first phase of South Cedar Street reconstruction; and
WHEREAS, Property owners that provide sufficient evidence of sidewalk replacements during the ten (10) years just prior to the commencement of the project, shall be given credit against their assessment, based upon the following schedule:
A property shall only be assessed:
• 10% of the sidewalk assessment if the walk had been replaced within one year of the project commencement.
• 20% of the sidewalk assessment if the walk had been replaced within two years of the project commencement.
• 30% of the sidewalk assessment if the walk had been replaced within three years of the project commencement.
• 40% of the sidewalk assessment if the walk had been replaced within four years of the project commencement.
• 50% of the sidewalk assessment if the walk had been replaced within five years of the project commencement.
• 60% of the sidewalk assessment if the walk had been replaced within six years of the project commencement.
• 70% of the sidewalk assessment if the walk had been replaced within seven years of the project commencement.
• 80% of the sidewalk assessment if the walk had been replaced within eight years of the project commencement.
• 90% of the sidewalk assessment if the walk had been replaced within nine years of the project commencement.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Monticello, Iowa that final payment to Horsfield Construction, not including retainage, related to the South Cedar Street reconstruction project in the amount of $98,958.31, is hereby approved and the work is accepted as complete, and directs the City Engineer to prepare the final plat and schedule of assessments related to this project, further directing the City Engineer, in preparation of the final assessments plat and schedule of assessments to calculate the assessments for sidewalk to benefitted properties based upon the installation of a standard 4’ sidewalk, not the 5’ or 6’ sidewalks that were installed on this project, and further directs the engineer to calculate said assessments based upon the following numbers: $3.25 sf for driveways, $3.00 sf for sidewalks, and $14.00 per lineal foot of frontage for curb and gutter, same being identical to the assessments calculated during the first phase of South Cedar Street reconstruction, and to further credit assessments related to sidewalks consistent with the schedule previously set forth herein
