RESOLUTION #10-85
Resolution finding the property and structures located at 224 N. Chestnut Street to be in violation of Monticello Code of Ordinances Chapter 50 “Nuisances”, Chapter 145 “Dangerous Buildings” and Chapter 153 “Property Maintenance”, and further finding that said structures should be condemned with the City Administrator
being directed to take immediate steps to begin the process of pursuing
the demolition of said structures.
WHEREAS, the City of Monticello has previously served the owner of 224 N. Chestnut Street, Al Hughes numerous Nuisance Abatement notices, and most recently served a formal notice to Abate under Chapters 50, 145, and 153 of the Monticello Code of Ordinances on Al Hughes on or about June 7, 2008, same providing a ninety (90) day period within which Al Hughes was to comply with the dictates of said Abatement Notice, and
WHEREAS, the Council granted an extension to Al Hughes, at his request, on September 6, 2008, with the understanding that he would complete the specific remedial measures he identified by written note delivered to the City Council for their consideration on September 22, 2010, with said remedial steps to be completed by no later than November 1, 2008, and
WHEREAS, Al Hughes has not completed the remedial measures he identified to the Council nor has he addressed the other hazards, dangerous conditions, and remedial measures identified by the May 19, 2008 Inspection Report of Tim Crab, ECIA Rehabilitation Specialist and Building Inspector, and while continual promises are made, he has made little to no progress towards remedying the identified deficiencies, nuisances, property maintenance, and dangerous conditions identified by way of the Abatement Notice dated June 7, 2008, and
WHEREAS, Mr. Hughes has failed to make progress on the property in 2010 although he has orally promised the completion of improvements, and has exacerbated the problems by having a large amount of firewood / trees dumped in the front yard of the property this spring, most of which has now been thrown into two basement window openings, where the windows have been removed, and
WHEREAS, the Council finds that prior action of the City Council, from 1999 to the present, has failed to bring about compliance by Mr. Hughes with the local Ordinances, and that his failure to comply, and the continued condition of his property in violation of the Monticello Code of Ordinances has a strong negative impact on neighboring property values, and that the best remaining course of action to be taken by the City Council is to pursue the abatement, by demolition, of the structures located on said property.
NOW, THEREFORE, BE IT RESOLVED that the City Council of Monticello, Iowa does hereby find the property and structures located at 224 N. Chestnut Street to be in violation of Monticello Code of Ordinances Chapter 50 “Nuisances”, Chapter 145 “Dangerous Buildings” and Chapter 153 “Property Maintenance”, does hereby condemn said structures, and directs the City Administrator to take immediate steps to begin the process of having the structures demolished.
