Resolution to accept Resignation of Chief of Police and to direct
Deputy City Clerk to meet final pay obligations to the Chief.
WHEREAS, the Police Chief has submitted his written resignation to the Mayor and City Council, and
WHEREAS, the Chief has requested that a two-week notice be deemed acceptable, and that he be paid his final two weeks of pay, from and including June 7th through June 20th, one full pay period, and
WHEREAS, The Police Chief’s Contract provides for the acceptance by the City Council of less than two-weeks notice at the Council’s direction, and the Council is further authorized to provide pay in lieu of notice as requested, and
WHEREAS, The City Council finds it appropriate to accept the Chief’s resignation, effective today, June 7, 2010, and to provide pay to the Chief of Police in lieu of that notice, with said final payroll payment to be made to the Chief of Police as part of the regular payroll, through June 20, 2010, with the understanding, however, that the Chief’s employment with the City will end upon the approval and authorization of this Resolution by the Mayor, and
WHEREAS, The Chief of Police has agreed and will be required hereby, to sign an acknowledgement that his last day of employment with the City is June 7, 2010, and but for the continuation of Health Insurance, Dental and Optometric coverage, which will all expire as of the 30th of June, 2010, he will no longer be entitled to any other benefits of employment with the City, and will not be considered to be employed by the City after June 7, 2010; that he has been fully compensated for any and all accrued time, leave, and/or other paid time off, and there is nothing left on the books for him to be compensated, and that his resignation is voluntary and for the purposes of accepting other employment.
NOW, THEREFORE, BE IT RESOLVED that the City Council of Monticello, Iowa does hereby accept the voluntary resignation of the Chief of Police, effective immediately upon the Mayor’s approval of this Resolution, and further authorizes the City Clerk’s Office to pay to the Chief two weeks of wages, as part of the regular City payroll for the period of June 7, 2010 through June 20, 2010, in lieu of the Chief working for the City during said two-week notice period, same being subject to the Chief executing the document contemplated by the paragraph immediately above hereto with regard to the end of the Chief’s employment, and the acknowledgement that all accrued time, leave, and/or other paid time off has been fully utilized by the Chief, and there is nothing left on the books for him to be compensated, and that his resignation is voluntary and for the purposes of accepting other employment.
