RESOLUTION #10-06
Approving Restrictive Covenants to lots located within Willow Ridge 2nd Addition, to the City of Monticello.
WHEREAS, Bob Faust, of Bob Faust Construction, Inc., approached the City of Monticello requesting the rezoning of certain lots located within Willow Ridge Second Addition, as more specifically described as follows:
Lot 14, 15, 16, 17, 19, and 20 of Willow Ridge Second Addition to Monticello, Iowa.
And
WHEREAS, The City of Monticello, Planning and Zoning Commission and Monticello City Council have both considered the re-zoning request of Faust, and have approved of same, modifying by Ordinance, the zoning of the above lots from R-1 to R-2, said change, however, being subject to the approval and recordation of restrictive covenants that would attach to said lots, the terms of same being as set out immediately below hereto:
Covenants:
If a two family residential property is built on any of the lots identified above, it is agreed as follows:
1). The living area, not including garage space, of each of the two units shall be at least 1200 sf.
2). Each of the two units shall be served by their own two stall / two car garages which shall be at least 880 sf. (20×22 minimum per unit)
3). The front of each structure, which shall include both units and garages, shall be covered with a brick or stone wainscoting, same to extend across the entire front of the structure from ground level to a height on the front of said structure of at least 36”.
And
WHEREAS, The Council finds the language of the restrictive covenants to be appropriate, and consistent with their direction, and further finds that Bob Faust has agreed to the institution of said covenants as a condition of the requested Re-Zoning.
NOW, THEREFORE, BE IT RESOLVED that the City Council of Monticello, Iowa does hereby approve the Restrictive Covenants as proposed, a copy of same being attached hereto same being incorporated within this Resolution, by this reference, as if set out fully verbatim herein. The City Clerk is directed to see to their recordation with the Jones County Recorder.
